Who you are dealing with

The games on heroharvestpowerbound.com, SIPHON and SIPHON: Hero Harvest (the "Games"), are created and sold by Jacob Bruley, an individual ("we", "us"). "Powerbound Games" is the studio name the Games are published under. When you play the Games or buy an unlock, your agreement is with Jacob Bruley.

Accepting these terms

By using this site or playing the Games, you agree to these terms. If you don't agree, please don't use the site. If you are under the age of majority where you live, you must have a parent or guardian's permission to make a purchase.

What you get

SIPHON is free to play. In SIPHON: Hero Harvest the first temple is free, and the rest of the adventure can be unlocked with a one-time purchase. Buying the unlock gives you a personal, non-exclusive, non-transferable licence to play the unlocked content for your own, non-commercial use. Unlock codes we give out for free are personal and may not be sold.

Payments, taxes and billing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, cancellations and refunds for purchases are governed by Paddle's Buyer Terms. Our own refund promise is in our refund policy.

Things you must not do

• Use the site or the Games for anything unlawful, fraudulent or to send spam.
• Copy, redistribute, resell or rehost the Games, their art, videos, music or code.
• Reverse engineer the Games or get around the paid unlock or other technical limits.
• Interfere with the site's security, including uploading malware, probing for weaknesses, overloading the site or scraping it with automated tools.
• Infringe anyone's intellectual property or other rights.

Ownership

We own the Games and everything in them, including the code, characters, artwork, videos, names, the Powerbound Games name and logo, and all related intellectual property. These terms don't transfer any of that to you.

Availability

We work to keep the Games running well, but we don't promise they will always be available, uninterrupted or free of bugs. We may update, change or remove features and content. The Games are provided "as is", and to the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Suspension and termination

We may suspend or end your access to the Games, including unlocked content, if you seriously or repeatedly break these terms, if a payment is not made or is reversed, or if your use creates a security or fraud risk. Game progress is stored only in your own browser, so ending access doesn't affect any data held by us.

Our liability

To the fullest extent the law allows, we are not liable for indirect or consequential losses, such as lost profits or lost data, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, such as for fraud.

Changes to these terms

We may update these terms. The new version will be posted here with a new date, and continuing to use the site means you accept it.
